Court of Justice of the European Union of Luxembourg, European Union

December 3, 2020
Negative
The action is dismissed as inadmissible. There is no longer any need to rule on the associations' requests to intervene. The Brussels Capital Region shall bear its own costs and pay those borne by the European Commission.

The region of Brussels sues the European Commission for its decision to renew the authorisation of glyphosate for 5 years. Justice Pesticides, Pesticide Action Network Europe (PAN EU), Health and Environment Alliance (HEAL), Nature & Progrès Belgique, SumOfUs and WeMove Europe moved to intervene in support of the plaintiff's claims. On 02/28/2019, the action is dismissed as inadmissible on the ground of lack of standing to bring proceedings. On 5/1/2019 the Region lodges an appeal against the order of the Court (case C-352/19 P). On 8/5/2019, the Walloon Region (Belgium) requests to intervene in the present case in support of the conclusions of the Brussels-Capital Region. On 10/9/2019, this request is rejected. In his 7/16/2020 conclusions, Advocate General Bobek considers that by denying standing to the Brussels Capital Region concerning the approval of the active substance glyphosate, the General Court erred in law and argues in favour of a more open interpretation of the criteria of direct concern. On dec. 1st, 2020, the appeal is dismissed.
