Greenpeace Nederland and PAN Europe have asked the Commission for access to several documents relating to the first marketing authorisation for glyphosate. The Commission has granted access to these documents, with the exception of part of the draft assessment report drawn up by Germany, indicating that this document contained confidential information protected by the intellectual property rights of the applicants. On 11/21, 2018, the Court held that the Commission correctly weighed the interests at stake, having set out precisely and concretely how the commercial interests of producers of glyphosate or plant protection products containing it were threatened by the disclosure of the disputed document. The action is dismissed in its entirety.
